2Katz Media specialize in professional real estate photography and videography, including drone services. By engaging with our services, you agree to the following terms and conditions:
1. Agreement Overview
1.1 These Terms of Service ("Terms") govern the relationship between 2Katz Media ("we", "our", "us") and you, the client ("you", "your") regarding the use of our photography, videography, and drone services ("Services").
1.2 By scheduling, using, or paying for our Services, you accept and agree to these Terms. If you do not agree to these Terms, do not use our Services.
2. Services Provided
2.1 We offer a range of real estate media services, including but not limited to, photography, video recording, and drone footage.
2.2 All services provided will be detailed in the Service Agreement and are subject to availability and scheduling.
3. Booking and Payment
3.1 To schedule a session, you must provide us with your details and the necessary information about the property.
3.2 Payment is due upon completion of the Services unless otherwise specified in writing. Accepted payment methods include [list accepted payment methods].
3.3 A deposit may be required to secure your booking. The deposit amount and terms will be outlined in the Service Agreement.
4. Cancellations and Rescheduling
4.1 Cancellations made less than 12 hours before the scheduled session will result in a cancellation fee of 25%.
4.2 Rescheduling requests must be made at least 12 hours before the scheduled session. Additional fees may apply based on availability.
4.3 We reserve the right to cancel or reschedule due to unforeseen circumstances or inclement weather. In such cases, we will work with you to reschedule or offer a refund of the deposit.
5. Usage Rights and Ownership
5.1 Upon full payment, you receive a non-exclusive, perpetual license to use the photos, videos, and drone footage for marketing, advertising, and promotional purposes related to the property.
5.2 Ownership of the original media remains with us. You may not sell, license, or otherwise distribute the media without our express written permission.
5.3 We reserve the right to use the media for portfolio, promotional, and marketing purposes.
6. Client Responsibilities
6.1 You must ensure that the property is ready for the session at the agreed-upon time. This includes removing any personal items or clutter that may impact the quality of the media.
6.2 You are responsible for obtaining any necessary permissions or permits for drone usage and photography, including those from property owners or relevant authorities.
7. Drone Operation
7.1 Drone operations are subject to local laws and regulations. We are licensed and insured for drone operations but you must ensure that you comply with all applicable regulations.
7.2 You acknowledge that drone flights are weather-dependent and that certain conditions may affect flight safety and media quality.
8. Liability and Indemnification
8.1 We are not liable for any indirect, incidental, or consequential damages resulting from the use of our Services.
8.2 You agree to indemnify and hold harmless 2Katz Media from any claims, damages, or losses arising from your use of the media or your failure to comply with these Terms.
9. Confidentiality
9.1 We will not disclose any confidential information or personal data obtained during the provision of our Services, except as required by law or with your consent.
10. Amendments
10.1 We may update these Terms from time to time. Any changes will be effective immediately upon posting on our website or notifying you directly.
11. Governing Law
11.1 These Terms are governed by the laws of the state where the property is located. Any disputes arising under these Terms shall be resolved in the courts located in that state.
